The suits challenge the company’s filing for bankruptcy to escape litigations.
3M made millions of military-grade earplugs through their subsidiary company Aearo Technologies, which were used routinely by the American military. However, both past and present servicemembers found those earplugs to be defective, and more than 230,000 lawsuits have been filed against Aearo for causing mass hearing loss among veterans and military personnel.
Aearo moved to file for bankruptcy, which if successful would dismiss all those lawsuits. To prevent this, affected servicemembers banded together to file a single lawsuit against Aearo’s bankruptcy filing, arguing that Aearo cannot go bankrupt if 3M is still legally its parent company.
“3M is a multi-billion dollar corporate enterprise that is not remotely in financial distress, and therefore should not be able to use the bankruptcy against the servicemembers it injured,” the group’s attorneys Bryan Aylstock and Chris Seeger stated.
